What Is a Fiduciary?

Dependability Derived from the ancient Latin legal term fiducia meaning “trust, confidence, reliance”, a Fiduciary is anyone who manages assets on someone else’s behalf for the exclusive benefit of that person. This role is assigned in the process of preparing one’s Estate or Trust, or when someone is in need of assistance managing their wellbeing. Assistance or management includes such acts as: paying bills; managing legal matters; financial management; medical care; and housing. It was from these needs and management demands that the Private Fiduciary profession grew.

What sets a Private Professional Fiduciary apart?

Accountability The Private Professional Fiduciary (PPF) relies on a standard of practice and code of ethics developed by the Professional Fiduciary Association of California (PFAC). California State took this a step further creating the Professional Fiduciaries Bureau to ensure that PPFs are licensed through an examination, bondable with a clear background check, and must follow California Probate Code. Ultimately PPFs answer to Probate Court, providing another layer of trust and accountability within the practice of meeting individual’s fiduciary needs.

Why might someone want a Private Professional Fiduciary?

Service Oriented Professional Fiduciaries serve those who do not have a family member or trusted friend with the skills or proximity to manage and protect their money and/or healthcare needs before and/or after they die. This includes seniors, people with mental and/or physical disabilities, and children.

Preparedness There are several common situations when someone may choose to hire a Professional Fiduciary. When preparing estate planning documents, a person with full mental capacity may name a private fiduciary to oversee health care or manage finances in the event of future incapacity.

Neutrality Family members may agree on a Licensed Professional Fiduciary to act as a court appointed conservator over their elder’s person and estate. For people with potentially difficult family dynamics, a Professional Fiduciary can serve as an independent third party to keep their clients safe and to protect their assets, minimizing family drama and preserve relationships among siblings and relatives.

  • Trustee/Successor Trustee: an individual person(s) or member of a board given control or powers of administration of property in trust with a legal obligation to administer it solely for the purposes specified.
  • Financial Management: the process of planning, controlling, and monitoring financial resources to achieve specific goals. It involves budgeting, saving, investing, and managing expenses to ensure financial stability and growth. As a fiduciary, our goal is the stable growth of your assets.
  • Power of Attorney for Finance: a legal document that appoints a trusted person the authority to make financial decisions and manage financial affairs on your behalf.
  • Power of Attorney for Healthcare: is a legal document that appoints a trusted person to make medical decisions for you if you become unable to make them yourself due to illness or incapacitation.
  • Court Appointed Conservator: is a legally appointed person who manages the personal care or finances of another adult, the "conservatee," who is unable to care for themselves or manage their own affairs due to illness, disability, or mental health disorder.

Fees

Fee Schedule

McCue Fiduciary Services bills fiduciary work at established hourly rates, with probate fees handled according to California statutory guidelines where applicable.

Fiduciary Work

Includes conservatorships of the estate and/or person, powers of attorney for finances and/or healthcare, and extraordinary time on decedents’ estates and trust administrations.

$225.00/hour

Billed in 6-minute increments. Rates are generally reviewed annually and may be adjusted effective January 1.

Blended Fee

Covers income logging, deposits, check writing, reconciliation of financial statements, storage, postage, and data entry.

$120.00/hour

Billed in 15-minute increments.

Probate Estates

California Probate Law establishes statutory fees for routine probate estate administration. Extraordinary work outside routine fiduciary services is billed separately.

  • 4% of the first $100,000
  • 3% of the next $100,000
  • 2% of the next $800,000
  • 1% of the next $9,000,000

Extraordinary probate services are billed at $225.00/hour. If extraordinary fees are requested, an itemized dated time summary is provided.

Trust Administration

Each trust is administered according to the trust instrument and the duties required. Trustee compensation is generally governed by the trust as fair and reasonable compensation.

  • Fiduciary hourly fee: $225.00/hour
  • Blended hourly fee: $120.00/hour
